Major victory for adult entertainment industry and the First Amendment. (KY

The
Kentucky Court of Appeals declared unconstitutional the McCracken County
Ordinance barring live nude entertainment as written and enforced. The Kentucky
Court of Appeals remanded the Ordinance back to the lower district court
resulting in a major victory for First Amendment rights and nude entertainment
in Kentucky. The Kentucky Court of Appeals found that the County’s
justification for banning nude entertainment was not justified in that the
County had not proven that crime was increased and/or property values were lower
in areas surrounding sexually oriented businesses and/or businesses featuring
adult entertainment. The Kentucky Court of Appeals required the County to prove
these allegations in order for the Ordinance to be upheld. The County has not
yet proven these allegations, but instead appealed the Kentucky Court of
Appeals’ decision to the Kentucky Supreme Court, which is currently on review.
The decision is a major victory for nude entertainment in Kentucky. Emily Roark
of Bryant Law Center argued the case before the Kentucky Court of Appeals and
persuaded them to rule in our clients favor.

Murder charge ends in 5-year sentence for battered wife. (03-CR-291 McCracken Co.)
A domestic dispute ended in death when a woman shot her ex-husband, following years of abuse. The woman had been a long-time victim of abuse from her ex-husband, with whom she still resided. She was a victim of extensive mental and physical abuse, on a daily basis. In addition, her abuser was a violent alcoholic. On the evening of the dispute, the victim and his ex-wife were involved in a physical altercation. As the fight escalated, the woman grabbed a gun off the refrigerator and shot her husband in the head. The woman was charged with murder and the prosecutor wanted a life sentence. The wife looked to our firm for help in this matter. Because of the circumstances that surrounded the evening of the shooting and the extensive abuse that the woman had endured, we felt strongly that she did not commit the offense of murder. We took the case to trial and proved that she suffered from Battered Woman's Syndrome, which was a result of several years of abuse from her husband. The jury returned a verdict of second-degree manslaughter, with a sentence of five (5) years. Back to top = |
