Dogged by thousands of lawsuits, pharmaceutical giant Bayer said in mid 2018 that it will halt sales of its controversial Essure permanent birth-control device in the United States at the end of 2018. The lawsuits allege Bayer did not disclose serious side effects and health problems from using the implanted device.

Thousands of women have blamed Essure for serious health problems: persistent pain and bleeding resulting from tears and cuts of the uterus and fallopian tubes and unwanted hysterectomies. The FDA in April 2018 added a boxed warning to the labeling and required patients to complete a checklist with their physician. Those steps led to a sharp sales decline.

Once inserted by a physician, Essure was supposed to cause permanent sterilization and it was not intended to be removed. The device consists of two inch-long, flexible coils made in part from an alloy of nickel and titanium. In an office procedure that does not require surgery, a doctor inserts the coils through the vagina and cervix and into the fallopian tubes, which carry eggs from the ovaries to the uterus. Over a three month period after insertion, scar tissue is supposed to form around the coils, creating a barrier that keeps sperm from reaching the eggs.

Bayer said its announcement terminating sales was a business decision and that Essure remains safe to use. The United States is the last country where Essure is being sold. Sales began in 2002. An estimated 750,000 of the contraceptive devices have been implanted in women around the world.

The FDA has: restricted the sale and use of Essure; is reviewing an ongoing clinical study to monitor Essure risks and imposed guidance for a boxed warning label.

Why are Essure lawsuits being filed?

Patients say if they had known about the dangerous physical side effects from having an Essure implant, they would have opted for other means of birth control. They allege Essure was negligently designed with defects that allowed it to separate and cause abdominal injuries.

What are the side effects of Essure?

Users have reported suffering severe abdominal tissue damage when the Essure device moves can tear or puncture the fallopian tubes and or uterus. Often, multiple surgeries have been required to recover different parts of the device that have moved inside the abdomen.
